MOTOR VEHICLE ACCIDENTS
$8 Million Settlement
Montgomery County – Our client, a minor, rear seat passenger received a settlement award as a result of neurological injuries suffered in a motor vehicle accident wherein the Defendant was operating a commercial vehicle and intentionally/recklessly collided with the minor’s vehicle after a road rage incident. A portion of the settlement funds were utilized to purchase an annuity which could provide lifetime benefits over $35 million.

Philadelphia County – Our client was killed as a result of a collision with a tractor trailer and received a settlement award in a disputed liability contest. The collision occurred after our client lost control of her vehicle and crossed the center line where she was struck by an oncoming truck. Philadelphia County – Our client, an electrician, was in the course and scope of his employment and while situated on a ladder and running cable through the ceiling of a classroom, the leg of the ladder fell into a hole in the floor, causing the Plaintiff to fall. He suffered a severe fracture of the right foot, permanent surgical scarring and disfigurement, and a permanent limp and weakness of the right foot.
PROPERTY DAMAGE CLAIM / SIX FIGURE CONFIDENTIAL SETTLEMENT AGREEMENT
A commercial property owner sustained water damage to his property as a result of heavy rains which caused the sewer lines to back up. The client’s property was inundated with raw sewage and water which caused significant damage to multiuse commercial/industrial property. The insurance company claimed that there was no coverage for this type of loss under the policy due to the fact that this was not a flood insurance policy; and because there were more than one source of water, i.e., the back up of drains and sewers as well as surface water. Under the terms of the policy, concurrent causation was an exclusion. Plaintiffs contended that the surface water was caused by the primary cause which was the back up of drains and sewers and that the surface water had nowhere to go. Had the sewer lines been clear, the surface water would have migrated to the sewer inlets and would have been evacuated from the property without causing damage. Plaintiffs also pursued a claim for bad faith on the part of the insurance company alleging that the company violated the Pennsylvania Unfair Insurance Practice Regulations as well as its own internal rules and regulations regarding the handling of claims. A confidential settlement agreement was entered into after two days of trial.

Philadelphia County – Our client received a jury verdict after proving that Defendants negligently dropped a large sign which was in the process of being erected. Plaintiff suffered torn shoulder muscles and a herniated cervical disc.

Luzerne County – Our client, a sign painter, received a settlement award after receiving injuries in an electrocution when the extended pole he was utilizing to paint a billboard came in contact with power lines which were in close proximity to the signage.

Value of the indemnity over his life expectancy of 35 years exceeds $600,000; his medical care and treatment is approximated at $3 million dollars.
